1.) Billing and change of address: There is a minimum rental period of 3 months for each instrument.  The credit card on file will be charged on the first day of the agreement and then automatically charged each month following.  It will be assumed that you will continue to rent your instrument month to month after the initial 3 month period until written or verbal notice is given wishing to cancel this agreement.  Notice of cancellation after the initial 3 month period is expected by the 1st of each month to ensure that your credit card is not charged.  NO MONTHLY BILLS WILL BE MAILED.  A card that is declined will result in a phone call from Bearclaw’s Academy of Music LLC. You are responsible for telling us of any mailing address, email address, phone number, and credit card changes that occur while you are renting the instrument. 

2.) Instrument security:  You agree that you will not sell, pawn, dispose of, or pledge the instrument as security while this agreement is in effect.  Do not leave the instrument in school if you wish to cancel this agreement.  You are liable for all payments and the total cost of rental until you receive an instrument receipt from Bearclaw’s Academy of Music LLC.  Your school is not a party in this rental agreement.

3.) Repair and Maintenance: You are responsible for the proper care, cleaning and maintenance of the instrument.

4.) Damage Waiver: The damage waiver included in the monthly rental fee will cover all repairs needed to make the instrument playable, during the rental period unless there are signs of neglect or intentional damage.  Any instrument that is returned broken beyond reasonable repair and unusable will result in your responsibility to pay Bearclaw’s Academy of Music LLC the full and complete payoff of the instrument and the instrument need not be returned.

5.) Theft or Loss: In the event of theft or loss of the instrument, you are responsible for the full and complete payoff of the instrument.

6.) Return of Instrument: After the initial 3 month rental period you may continue to rent month to month or return your instrument.  If there are signs of neglect or intentional damage, you will be liable for necessary repairs and/or replacement of the instrument.  Also all original accessories such as mouth pieces, instrument parts and bows etc., must be returned with the instrument or you must pay for them.  DO NOT LEAVE THIS INSTRUMENT IN SCHOOL.  IT MUST BE RETURNED TO US.

7.) You understand and agree that this Agreement may be assigned to a third party for DEBT collection.
